Terms and Conditions of Use for UpNext

Welcome to UpNext! These Terms and Conditions (“Terms”) govern your use of the UpNext mobile application (“App”) and all related services provided by Psounds Limited p/k/a UpNext (“we,” “our,” or “us”). By using the App, you agree to these Terms. If you do not agree, you must not use the App.

1. Eligibility

  • The App is available to individuals aged 16 and older.

  • Users under the age of 18 are not required to verify their age but must have parental or guardian consent to use the App.

  • By using the App, you confirm that you meet these eligibility requirements.

2. Account Creation

  • Users must create an account to access certain features of the App.

  • Account creation using third-party platforms (e.g., Google or Apple ID) is not supported.

  • You may delete your account directly within the App. Once deleted, your data may no longer be recoverable.

3. User Content and Licensing

  • Uploading Content: Users may upload content such as beats, tracks, and services.

    • Beats: Users are not required to verify ownership rights when uploading beats.

    • Other Media: Users must confirm ownership rights and verify their account before uploading.

  • Content Display: User-submitted content will only be displayed within the App and not used for public promotions outside the platform.

  • Moderation Policy:

    • Users must not upload objectionable content, including inappropriate or copyrighted material.

    • Users may report objectionable content using the in-app reporting feature.

    • UpNext will act on such reports within 24 hours, and offending content or accounts may be removed.

  • By uploading content, you confirm you have the necessary rights or permissions to do so.

4. Payments and Refunds

  • Payment Processing: Payments are processed securely through Stripe.

  • Refund Policy:

    • Refunds are available for services that are not completed on time or correctly.

    • No refunds are provided for beats or contest entries.

  • Disputes: We will mediate disputes related to paid services (e.g., failed services or quality concerns). Our decision will be final and binding.

5. Contests

  • Entry Fees: Most contests are free to enter. A select few may require entry fees.

  • Winner Selection: Winners are selected based on judged criteria, not public voting or automated ranking.

  • Prizes: Contest prizes may include monetary rewards, physical items, promotional opportunities, or written feedback.

  • Generic Contest Rules: Generic contest rules will apply to all contests and will be linked within the contest details.

  • Disclaimer: Apple Inc. is not involved in any way with the contests offered on UpNext.

  • Eligibility: Contests are open to users worldwide, without restrictions on age or location.

6. Beats and Professional Services

  • Licensing: Beats are sold under non-exclusive licenses, allowing producers to sell the same beat to multiple buyers.

  • Commission: UpNext retains 30% commission on all sales of beats and services made through the App.

  • Licensing Disputes: Any disputes about the use or misuse of purchased beats are the sole responsibility of the buyer and the producer.

7. User Behavior and Restrictions

  • Prohibited Behavior: Users must not engage in:

    • Spamming, harassment, or abusive behavior toward other users.

    • Uploading content that infringes on intellectual property rights or violates applicable laws.

    • Sharing objectionable content.

  • Reporting and Removal: Users may report objectionable content through the in-app reporting feature. UpNext will act on reports within 24 hours and may remove content or ban offending users.

  • Community Guidelines: All users must adhere to our community guidelines when interacting with others on the platform.

8. App Updates and Availability

  • Updates: While updates may improve functionality, users are not required to update the App to continue using it.

  • Availability: We have no current plans to suspend or shut down features or the entire App.

9. Limitation of Liability

  • UpNext is responsible for mediating disputes between users when payments for services have been made but the service has not been delivered as agreed.

  • Other disputes arising from third-party interactions on the platform may also be addressed by UpNext, but we do not guarantee a resolution in all cases.

10. Governing Law and Disputes

  • These Terms are governed by the laws of the United Kingdom.

  • Disputes will be resolved exclusively in the courts of the United Kingdom unless otherwise required by law.

  • The App operates globally and adheres to the applicable laws of the countries in which it is available.
